— Why 'I'll Do It Later' Is the Most Dangerous Thought in China Patent Strategy

I hear this phrase constantly from inventors:

'I'll file once my prototype is ready.'

Or: 'I'll file after I test the market.'

Or worse: 'I'll file when I see a competitor.'

Each time, I feel a knot in my stomach — because I know what happens next.

They wait. And then someone else files first.

And then it's too late.


A Story I See Every Month

A European inventor developed a brilliant new kitchen gadget. It was simple, elegant, and solved a real problem. He spent two years perfecting the design, testing materials, and running focus groups.

He proudly showed it at a trade show in Frankfurt. The response was overwhelming. Retailers wanted it. Distributors called.

Then he went home, incorporated a company, and started planning his launch.

Six months later, he received an email from a Chinese manufacturer. Attached was a patent certificate.

The manufacturer had filed a patent application in China for his invention — based on nothing more than the photos and specifications he had posted on his website after the trade show.

His options?

  • Sue in China? Too late. The patent belonged to the manufacturer.
  • Stop the manufacturer from selling? No. They had the rights.
  • Sell his product in China? No. He would be the infringer.

He lost a market of 1.4 billion people because he waited.


The Rule You Cannot Change

China operates under a 'first-to-file' patent system.

That means:

It does not matter who invented it first.
It only matters who filed the patent application first.

This is not a minor procedural detail. This is the central rule of Chinese patent law.

  • You can be the true inventor.
  • You can have the earliest sketches.
  • You can have the first working prototype.

If someone else files a patent application in China before you — even if they saw your product online, even if they copied your design — they will own the rights.

And you will be the infringer.


Why This Rule Exists

The 'first-to-file' system is designed to create certainty.

China's patent office processes over 1.5 million patent applications every year. If they had to investigate who 'actually invented' each one first, the system would grind to a halt.

So the law says: whoever files first gets the presumption of ownership. It's simple. It's predictable. And it's brutal if you are late.

But here's what most foreign inventors don't realize:

China's 'first-to-file' system is not a secret. It is not a trap. It is a known rule — and you are expected to play by it.

If you choose not to play, you are not being 'smart.' You are gambling.


The 'Not Ready Yet' Trap

Here are the most common excuses I hear — and why each one is dangerous:

Excuse 1: 'My product isn't finished yet.'

You don't need a finished product to file a patent in China. You need a disclosure — a description of what your invention does and how it works.

  • You can file a utility model patent with just drawings and a description.
  • You can file an invention patent with provisional-level detail.
  • You can always file a more complete application later and claim priority from your first filing.

Excuse 2: 'I haven't done market testing yet.'

Market testing is valuable — but it exposes your invention. The moment you show your product to potential customers, partners, or even the public, you are giving others the information they need to file before you.

If you want to do market testing, file first — or use a non-disclosure agreement (NDA) with everyone who sees it. And even then, an NDA does not protect you against someone who independently files.

Excuse 3: 'I can't afford it right now.'

A China patent filing costs $2,500–$4,500. Losing your rights in the Chinese market can cost you millions.

If you truly cannot afford to file, consider:

  • Filing a utility model patent — it's cheaper and faster
  • Filing a provisional application (if available under your home country's system) and claiming priority later
  • Getting a fixed-fee quote from a licensed agent — so you know the exact cost upfront

Excuse 4: 'I'll file when I see a competitor.'

By the time you see a competitor, they may have already filed. Chinese patent applications are published 18 months after filing — so you may not even know they filed until it's too late.

Waiting to see a competitor is like waiting to see smoke before you buy a fire extinguisher. By the time you see the smoke, the fire is already there.


What the Smart Inventors Do

The inventors who succeed in China understand the 'first-to-file' reality. They act accordingly:

Step 1: File as early as possible.
You don't need a perfect patent application. You need a filing date. You can perfect the application later.

Step 2: Keep your invention confidential until you file.
Don't post photos online. Don't demo at trade shows. Don't discuss details with potential partners — unless they have signed an NDA, and even then, be cautious.

Step 3: File in China within 12 months of your first filing anywhere.
Under the Paris Convention, you have 12 months to claim priority from your first patent filing. After that, your priority right expires — and anyone else can file before you.

Step 4: Work with a licensed Chinese agent who moves fast.
Your agent should be able to prepare and file your application within 2–4 weeks of receiving your disclosure. Delays in filing are delays in protection.

Every trade show you attend without filing is an opportunity for someone else to see and copy.

You don't need to be faster than everyone. You just need to file before anyone else.
