— Why Most China Patent Applications Are Granted — If You Respond

I receive calls like this every week:

'CNIPA rejected my patent application. I guess it's over.'

'What did the rejection say?'

'I don't know. It's in Chinese. I just saw 'rejected' and gave up.'

This is one of the most heartbreaking conversations I have.

Because in most cases, the application is not dead. It is not even close to dead.

The inventor has simply given up — because they didn't understand what an office action really means.

What an Office Action Actually Is

In China, an office action — sometimes called a 'rejection' or 'notice of refusal' — is a routine part of the examination process.

It is not a final decision. It is not a death sentence. It is simply the examiner saying:

'Based on what I see so far, I have concerns. Please respond.'

China's patent examiners are thorough. They review each application carefully. And because they are thorough, they almost always issue at least one office action for invention patent applications.

Here is the reality:

Most invention patent applications in China receive at least one office action. Most of them are eventually granted — after one or two rounds of response.

The applicants who abandon their applications are not the ones who received office actions. They are the ones who did not respond.

A Story of Giving Up Too Soon

A U.S. inventor filed a patent application in China for a new type of drone propeller. He spent months working with his agent to draft the application. He paid the fees. He waited patiently.

After about two years, he received an office action. The examiner said the claims were not sufficiently inventive over prior art.

The inventor was frustrated. He had already spent money. He had waited two years. Now he was being told 'no.'

He decided to abandon the application. He told himself: 'I'll just focus on the U.S. market.'

What he didn't know was this: his agent had a clear strategy to overcome the rejection. The examiner's objections were standard. The claims could have been amended. A simple response would have put the application back on track.

But the inventor never asked. He just assumed 'rejected' meant 'dead.'

Why Office Actions Are Issued

Chinese examiners issue office actions for many reasons, including:

Most of these are addressable. A skilled agent can:

• Fix formal defects and resubmit
  

A rejection is not a 'no.' It is a 'please explain.'

What Happens When You Don't Respond

If you receive an office action and do not respond within the time limit (usually 2–4 months), your application will be deemed withdrawn. That means:

• You lose your filing date
  
• You lose your priority claim
  
• You lose the fees you have already paid
  
• You lose the opportunity to ever protect that invention in China
  

This is the only way a patent application truly dies.

Not because of the examiner's objections. Because the applicant failed to respond.

What Happens When You Do Respond

When you respond to an office action, one of three things happens:

1. The examiner accepts your arguments and grants the patent.
This happens in many cases — especially if your agent has prepared a strong response.

2. The examiner issues a second office action.
This is also common. The examiner may accept some of your arguments and raise new issues. You respond again. This can happen 1–3 times.

3. The examiner issues a final rejection.
This is rare. Even then, you may have options — including filing a request for re-examination or appealing to the Patent Re-examination Board.

The majority of applications that receive office actions are eventually granted.

What You Need to Know About Office Actions

You Have Time — But Not Forever

When you receive an office action in China, the deadline to respond is typically:

• 2 months from the date of receipt for an invention patent
  
• 1 month from the date of receipt for a utility model or design patent
  

You can usually request a one‑time extension of up to 2 months. But do not assume the deadline is flexible. Missing the deadline means losing your application.

You Need a Strategy, Not Just a Translation

Responding to an office action is not as simple as translating the examiner's comments and replying in English. You need to:

• Understand the examiner's legal reasoning
  
• Identify the specific claims that are challenged
  
• Decide whether to amend claims or argue against the examiner
  
• Submit supporting evidence (if available)
  
• Frame arguments in the language of Chinese patent law
  

This is not a do‑it‑yourself project.

The Examiner Is Not Your Enemy

Chinese examiners are professionals doing their job. They are not trying to reject your application — they are trying to make sure only valid patents are granted.

If you respond professionally and persuasively, the examiner will work with you. The examination process is a dialogue, not a confrontation.

They do not panic.

Step 1: They ask their agent what the office action means.
They don't just read 'rejected' and stop. They ask: 'What are the specific objections? Can we overcome them?'

Step 2: They give their agent the information needed to respond.
If the examiner questions novelty, they provide evidence of earlier public disclosure or prior art differences. If the examiner questions inventive step, they explain why their invention is not obvious.

Step 3: They trust the process.
They know that most applications are granted after one or two rounds of office action. They stay patient and stay engaged.

Step 4: They respond on time.
They never miss the deadline. They never assume they can respond later.

The Reality of China Patent Examination

The Bottom Line

A rejection is not a 'no.' It is a 'please respond.'

Most inventors who abandon their applications do so because they misunderstand the process. They think the examiner is saying 'this will never be granted.' In reality, the examiner is saying 'here is what I need to see before I can grant it.'

If you have a licensed agent who knows how to respond — and you are willing to stay engaged — your application has a very good chance of being granted.

Do not give up at the first sign of resistance.
