Why You Should File a Patent in China

If you manufacture in China, source from China, or sell to China — you need a Chinese patent.

It is that simple.

But most foreign inventors and small businesses don't understand why. They think of China patents as a 'cost' or a 'burden.' They don't realize that a Chinese patent is not an expense — it is leverage.

Leverage over your supply chain. Leverage over your competitors. Leverage over the world's most powerful manufacturing ecosystem.

Here is why China's patent system matters — and why you cannot afford to ignore it.


The Reality: China Is the World's Factory

China is not just one manufacturing location. It is the manufacturing location.

  • China accounts for approximately 30% of global manufacturing output
  • China is the world's largest exporter of electronics, machinery, consumer goods, and medical devices

1. Stop Your Chinese Manufacturer from Becoming Your Competitor

Your manufacturer has your designs. They have your specs. They have your trust. With a Chinese patent, you can:

  • Demand they stop manufacturing your product for anyone else
  • Demand they stop selling to your competitors
  • Sue them for damages if they continue

Without a Chinese patent, they can do all of this — and you can do nothing.

2. Block Your Competitors from Using the Same Supplier

Your competitors also source from China. If they ask a Chinese supplier to copy your product, you can:

  • Send a cease-and-desist letter to the supplier
  • Block the supplier from manufacturing any copycat products

3. Stop Copycats from Exporting to Your Markets

The most common way copycats enter your market is through exports from China.

If you have a Chinese patent, you can:

  • Register it with Chinese customs for border enforcement
  • Block copycat products at the Chinese border before they leave the country
  • Force the copycat to negotiate or abandon the market

Without a Chinese patent, there is nothing stopping them.

4. Force Competitors to License from You

  • Demand a license fee for every unit they manufacture or sell
